DISCIPLINARY MEASURES BY THE COUNCIL

In order to maintain its high standards, the Council has never hesitated in taking disciplinary action against candidates as well as other people who indulge in examination malpractices.

The Council has evolved rules which cover the following offences/malpractices among others:

  1. Bringing foreign material into the examination room
  2. Irregular activities inside or outside the examination halls (eg Stealing scripts of other candidates, refusing to submit script, tearing part of answer booklet/question paper)
  3. Collusion
  4. Impersonation
  5. Leakage
  6. Mass cheating
  7. Insult/Assault on Supervisors or Invigilators

PENALTIES

Depending on which rules are infringed and the magnitude of the offence committed the following penalties are levied:

  • Cancellation of individual subject results;
  • Cancellation of entire results;
  • Banning of candidate(s) from all examinations conducted by the WAEC for a specified period of time.
  • Prosecution at the Courts of Law;
  • In cases where the schools or centres are found to have been involved in leakage or mass cheating, their entire results are cancelled and the centre derecognised for a period not less than one year.


THE WAEC LAW - ACT 719 (2006)

  NATURE OF OFFENCE

PECUNIARY AND/OR TERM OF PENALTY IMPRISONMENT AND OTHER SANCTIONS

1. A person who before or during an examination:

(a)  is in possession of an examination paper.

(b) is found to have had fore- knowledge.

(c ) makes use of an examination paper or the contents in any manner whatsoever.

Minimum of

GH˘1,200

And

Maximum of
GH˘3,000

Not more than two years imprisonment.

Council shall in addition:

(a) disqualify the candidate from taking the examination and cancel entire results.

(b) prohibit the candidate from taking any of the Council's examinations for 2 years.

2. A person who :

Before or during an examination:

(a) gives an examination paper to another person.

(b) discloses the contents of an examination paper to another.

(c) makes a change in the original script of a candidate.

(d) fraudulently replaces the original script of a candidate.

(e) fraudulently alters the result of a candidate.

(f) fraudulently alters the examination number, photograph or other identification of a candidate.

(g) acts in a manner with the intent to falsify the records of the Council.

Minimum of

GH¢1,200

And

Maximum of

GH¢3,000

Not more than one year imprisonment.

3. Impersonation

Minimum of

GH¢600

And

Maximum of

GH¢1,200

Not more that one year imprisonment.

In addition:

Be prohibited from taking the examination for a period of three years.

4. A candidate who during an examination:

(a) copies from the script of another candidate.

(b) communicates with (c ) is in possession of a textbook, electronic device or material.

(d) copies from notes, electronic device or textbook.

(e) receives external assistance. another candidate.

Minimum of

GH¢600

And

Maximum of

GH¢1,200

Not more than one year imprisonment.


In addition:

(a) Be disqualified from taking the examination.

(b) If the person has already taken a paper at the examination, the paper shall be cancelled by the Council.

5. A candidate who, before, during or after an examination is found in possession of offensive material with the intent to assault an invigilator, inspector, supervisor, an authorised officer of the Council or another candidate.

Minimum of

GH¢900

And

Maximum of

GH¢1,800

Not more than 15 months imprisonment.

In addition:

(a) Cancellation of entire results.

(b) Council may prohibit candidate from taking the examination for a period not less than two years.

6. Assault on Invigilator, Supervisor, Inspector or another candidate before, during or after an examination.

Minimum of

GH¢1,200

And

Maximum of

GH¢2,400

 

 

Not more than 18 months imprisonment.

In addition:

(a) Council shall cancel entire results and

(b) prohibit candidate from taking the examination for a period not less than two years.

7. A person who aids, abets, induces, incites or facilitates the commission of an offence under this Act.

Same as penalty prescribed in relation to the offence.

The penalty or term of imprisonment prescribed under the respective section.

8. Where in an investigation or trial a candidate is found to have had access to an examination paper or to have had foreknowledge or cheated in an examination.

 

The Council shall take action, including the cancellation of examination results and cancellation of a certificate issued to the candidate.

9. Where more than one-third of the candidates at a school either before, during or after an examination are found to have contravened the provisions of the Act.

 

 

The Council may prohibit that school from organising, supervising or acting as an agent in the conduct of the examination for a period.
